1. Acceptance of Terms

By accessing or using FSBOMarine.com (“the Site”), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site. These Terms apply to all visitors, registered users, sellers, and any other parties who access the Site.

2. About FSBOMarine

FSBOMarine.com is an online marketplace that allows private boat sellers to list vessels for sale and enables buyers to browse those listings. FSBOMarine is a brand of One 8 & Company LLC, a New York limited liability company. FSBOMarine is not a broker, dealer, or licensed vessel salesperson and does not participate in, facilitate, or guarantee any transaction between buyers and sellers.

3. Listings

Listing content is submitted directly by sellers. FSBOMarine does not verify, warrant, or guarantee the accuracy, completeness, legality, or condition of any listing or vessel described therein. Buyers are solely responsible for independently verifying all listing information, including but not limited to vessel condition, specifications, title status, registration, and pricing, prior to entering into any agreement or transaction.

FSBOMarine reserves the right to remove any listing at its sole discretion, including listings that are inaccurate, fraudulent, or in violation of these Terms.

4. User Accounts

To list a vessel or access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when registering and to update that information as necessary.

FSBOMarine reserves the right to suspend or terminate accounts that violate these Terms or that are associated with fraudulent or harmful activity.

5. Seller Responsibilities

By submitting a listing, sellers represent and warrant that:

• They are the legal owner of the vessel or are authorized to sell it
• All listing information is accurate and not misleading
• The vessel is legally available for sale and free of undisclosed liens or encumbrances
• They will comply with all applicable federal, state, and local laws governing the sale of the vessel

Sellers assume full responsibility for their listings and for any transaction arising from them.

6. Buyer Responsibilities

Buyers acknowledge that FSBOMarine is not a party to any transaction and that all purchases are made directly with sellers. Buyers are solely responsible for conducting due diligence, including independent inspections, title searches, and confirmation of vessel documentation, prior to completing any purchase.

7. Advertiser and Affiliate Relationships

The Site may display advertisements from third-party marine industry businesses. FSBOMarine may also participate in affiliate programs through which we may earn a commission or referral fee if you click on a link and subsequently purchase a product or service from a third party, including but not limited to marine insurance providers and financing institutions.

Affiliate relationships do not influence listing content or editorial decisions. FSBOMarine is not responsible for the products, services, or representations of any advertiser or affiliate partner. Any transaction you enter into with a third-party advertiser or affiliate is solely between you and that party.

8. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings
• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site or its systems
• Scrape, harvest, or collect data from the Site without written permission
• Interfere with the operation of the Site or other users’ experience
• Use the Site to transmit spam, malware, or unsolicited communications

9. Intellectual Property

All content on FSBOMarine.com not submitted by users, including the FSBOMarine name, logo, design, and original written content, is the property of One 8 & Company LLC and may not be used, reproduced, or distributed without written permission. User-submitted listing content remains the property of the submitting user; by posting a listing, you grant FSBOMarine a non-exclusive, royalty-free license to display that content on the Site.

10. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied. One 8 & Company LLC disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, One 8 & Company LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any listing, or any transaction between buyers and sellers, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed one hundred dollars ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless One 8 & Company LLC and its members, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your listings, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York State.

14. Changes to These Terms

FSBOMarine reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
